What is Operator Competence?

According to Defra, technical competence to carry out a waste activity requires legal waste operators to:

  • Have 'sufficient control' over day-to-day operations to comply with permit conditions.

  • Know how to operate the necessary equipment.

  • Comply with the law and government policies.

  • Minimise the impact of the activity on people and the environment.

When an individual or company applies for a new permit, or transfers or changes a permit, the environmental regulator examines the application and decides whether the applicant is competent to comply with the conditions.

How do I demonstrate Operator Competence?

To demonstrate competence, legal waste operators join and comply with the requirements of one of two schemes approved by Defra and the Welsh Government for use in England and Wales.

One of these approved schemes is the CIWM (WAMITAB) Operator Competence Scheme, which requires operators to gain a primary competence qualification, units and/or Environmental Permitting Operators Certificate (EPOC) (depending on risk level shown in the risk tier tables) and then pass a Continuing Competence assessment every two years to demonstrate their technical competence is being kept up to date.

In Northern Ireland, the current waste management licensing and permitting regime requires operators to demonstrate technical competence by obtaining the relevant primary competence qualification (listed in the risk tier table for Northern Ireland) and then pass a Continuing Competence assessment every two years to ensure their technical competence remains up to date.

Structure of Operator Competence

The scheme is made up of two core components:

Primary Competence

Primary Competence is achieved when an individual completes the required qualification, units, or training relevant to their role and facility. This demonstrates that the person has the technical knowledge and practical understanding required to manage a permitted waste site.

Primary competence is typically linked to specific risk-based qualifications depending on the type of facility operated.

ABOUT PRIMARY COMPETENCE

 

Continuing Competence

Continuing Competence ensures that qualified individuals remain up to date with industry standards, regulations, and best practice. To ensure ongoing compliance and professional development, reassessment is required every two years. 

Failure to maintain continuing competence may result in loss of recognised operator status.
