Online Purchases - General Terms

By clicking the "Continue" button, “You” (the individual and/or organisation for whom You are making the purchase online) are agreeing to these terms and conditions. By completing and submitting the electronic order form You are making an offer to purchase goods or services, which, if accepted by any member of the CIWM Group (including, but not limited to, the Chartered Institution of Wastes Management and CIWM Enterprises Limited, hereinafter together referred as “CIWM”), will result in a binding contract. Your card will be debited when You click the "Submit" button in the card payment confirmation area. Taking payment from Your card does not indicate automatic acceptance of Your order. Should the order be refused, your payment will be refunded. Please read the terms and conditions below relating to Your particular purchase.

1. All CIWM Training Courses and Events including Dinners, Workshops and Master Classes (but excluding e-learning, CIWM London & SC Centre  Annual Christmas Luncheon) – cancellation terms

Cancellation/amendment of any confirmed bookings for events/courses are subject to the following cancellation policy:

Details of all cancellations or amendments requested, including substitute delegates, must be notified in writing to CIWM at training@ciwm.co.uk ; or events@ciwm.co.uk. Notification is only valid if received prior to the event/course commencing.

If notice of cancellation is received 28 days or more prior to the event/course a 50% cancellation fee will apply; if notice is received less than 28 days prior to the event/course a 100% cancellation fee will apply. Substitute delegates will be accepted but, as stated above, must be notified in writing.

Any amendments, other than substitution, will incur additional fees.

CIWM reserves the right to change the date, venue, content, speakers and/or timing of an event/course.

CIWM also reserves the right to cancel events/courses. 7 day’s notice will be given of such cancellation and CIWM will make a full refund of fees paid but disclaims any further liability. You are advised not to make confirmed travel/accommodation arrangements more than 7 days prior to an event/course commencing, or until joining instructions have been received.

2. CIWM e-Learning products

CIWM’s e-Learning products are delivered via the CIWM e-Learning Portal (the portal). Users will be provided with a unique user name and password (their log-on details to access the portal), which protects the security of the resources and enables CIWM to monitor the user’s access to the e-Learning Portal.  Users must not share their log on details with anyone else and CIWM reserves the right to remove access to the portal where it believes that log on details have been shared. 

Purchasers of e-Learning products are advised to check that they have the following technical set-up before purchasing e-Learning:

  • a steady internet connection
  • an up-to-date browser with Flash player (Chrome is recommended. Firefox is not compatible)
  • cookies enabled 
  • pop-up blockers switched off.
  • The CIWM’s WasteSmart product has voiceover so users of this product will need sound. 

 CIWM shall have no responsibility or liability towards the user’s inability to access the Online Learning System/Learning Portal due to issues beyond CIWM’s control including but not limited to the technical set-up issues specified above. Users of e-Learning products are advised to check the Trouble shooting instructions available here.

Users will only be given access to their e-Learning once full payment has been received via card payment or bank transfer. Users are usually given 30 days’ access to the WasteSmart certificate and 90 days to other e-Learning products. Once this time has expired the user’s access to the e-Learning product will automatically cease. CIWM may charge users a fee, including the full product fee again, to reinstate access. 

Where access to the portal is funded by a user’s employer, CIWM may report user’s usage, including any assessment results, to the user’s employer

Where an e-Learning Product includes an assessment; users will be required to complete and pass the assessment to receive their completion certificate. CIWM reserves the right to charge users for resits where a user exhausts assessment attempts. 

Users should download their completion certificate prior to their product access expiring. CIWM reserve the right to charge a fee for the provision of certificates after a user’s product access has expired. 

CIWM will not be liable if for any reason the portal is unavailable at any time or for any period. CIWM may offer full or part refunds or extend the user’s access period in its absolute discretion if it feels that the access to the e-Learning product has been interrupted for a significant period of time due to unavailability of the portal. 

CIWM may allow an e-Learning licence to be passed to another user if the original user has not accessed the service at all. CIWM reserves the right to charge a fee to set-up new users and to transfer licences between users. Transfers are at CIWM’s complete discretion.

Refunds: cancellations must be made only by writing to training@ciwm.co.uk within fourteen (14) days from the date of purchase. A refund will be offered provided that the appropriate conditions have been met. When a refund request is received, CIWM reserves the right to track the usage by an individual (through his/her username and password) of specific pages viewed, frequency of use and time of use. The option to cancel the order and refund is not available if:

  • The user has viewed, accessed any of the course material and utilised, beyond the login point;
  • The fourteen (14) day cancellation period has expired;

 

3. CIWM London & SC Centre Annual Christmas Luncheon 

There is a limit on numbers and the allocation of tickets will be on a first come, first served basis.  Subject to statutory provisions, refunds cannot be made once tickets have been purchased under any circumstances.  Late booking cannot be guaranteed places and may attract a surcharge. Bookings are not confirmed until paid in full.

4. Special Offers

We reserve the right, from time to time, to run special promotional offers on events. Special Offers may include, but are not limited to, price promotions. In the event of a Special Offer, additional terms and conditions may apply which will be made available at the time of booking. Any places booked at an Event prior to the Special Offer will not be offered the promotion retrospectively, unless specifically agreed by CIWM.

5. Our Liability

Event attendees shall be required to keep their personal belongings with them at all times and we accept no liability for damage to, or loss of, personal belongings. We do not accept any responsibility for any loss (including, without limitation, theft) of any property occasioned on our premises or at external venues save for any damage caused by our negligence in which circumstances our liability shall be limited to the amount of our insurance for such losses.
We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions.

Our online products including but not limited to e-Learning may contain links to other websites. These are provided for your convenience. They do not signify that we endorse those websites. We do not have any control over those sites and have no responsibility for the content on the linked website(s).

All the information contained in CIWM materials including but not limited to training materials, brochures, courses, e-learning products is for use and guidance only. It does not constitute professional advice. You should neither act, nor refrain from action, on the basis of the information provided. You should take, as and where appropriate, relevant professional advice on your particular circumstances.

Nothing in these online purchase and event booking terms and conditions excludes our liability to you for personal injury or death caused by our negligence.

6. Rights in Materials

All copyright and other rights (including all intellectual property rights) in materials provided to you during or for the purposes of any of our Events (including, without limitation, course notes, slides, brochures, articles or case studies, e-learning materials) are the property of CIWM or of our speakers. You are entitled to use such materials only for your own personal use. You are not entitled to copy such materials (except as permitted by law) nor are you entitled to use or authorise others to use such materials for any commercial purposes. 

Whilst we make reasonable efforts to ensure the accuracy of our Course Materials, we do not represent, warrant or guarantee that the Course Materials will be error free. For the avoidance of doubt, we will not refund Course Fees on the basis that Course Materials are not error free, accurate and/or up to date.

7. Photography

An official photographer will be present throughout the event. Photographs taken may be used by CIWM for our marketing and promotional purposes; and to publicise our future events. Images may also be taken by members of CIWM staff to be used in press releases, and published in printed and electronic publicity materials, and via our social media online accounts including twitter and LinkedIn. The images will be stored securely, and will be deleted when no longer needed. If you do not wish to be included in any photograph, please notify the photographer at the event.

Please note: CIWM is not responsible for pictures taken on their personal phone/camera by other delegates attending the events nor for those images or any comments published by them on social media.

8. Data Protection

CIWM will process the information it receives from you or otherwise holds about you in accordance with these Terms and the CIWM Privacy Policy. CIWM will use such information for purposes including but not limited to:
a) to process Your order and to provide You with the product You have purchased;
b) as set out in further detail in CIWM's Privacy Policy

If You would prefer not to receive this communication You can update Your preferences or unsubscribe at any time either by following the link on any CIWM Group email or newsletter; or by logging into Your account and selecting the relevant boxes/options in the communication preferences centre; or by contacting us - email helpdesk@ciwm.co.uk.

CIWM and its group do not share or sell Your data to any third party organisations; but, where strictly necessary, may share data with carefully selected organisations working on CIWM’s behalf, including contractors undertaking some data processing.

9. Our Right to Vary these Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time to reflect changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and to meet our changing business requirement;
You will be subject to the policies and terms and conditions in force at the time that you purchase or place a booking with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to bookings previously made by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Booking Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Booking Confirmation).

10. Force Majeure

CIWM shall assume no liability whatsoever if any of its events, courses or other scheduled activities cancelled, rescheduled or postponed due to an unexpected event, Act of God, unforeseen occurrence or any other event that renders performance of this conference impracticable, illegal or impossible. For purposes of this clause, an unexpected event shall include, but not be limited to: war, fire, labour strike, extreme weather or other emergency. However, in exceptional situations CIWM at its own discretion may compensate the individuals for their loss incurred due to force majeure.  

11. Law and Jurisdiction

Contracts for the booking of Our Events or purchasing through Our Site will be governed by the law of England and Wales. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
