Description The Corporate Manslaughter Act received Royal Ascent in July 2007 and is anticipated to become law in April 2008. It will mean for the first time companies and organisations can be found guilty of corporate manslaughter on the basis of gross corporate failures in health and safety. The Corporate Manslaughter and Corporate Homicide Act will make it easier to prosecute companies who fail to protect people.

The legislation is designed to send out a very powerful deterrent message to those organisations which do not take their health and safety responsibilities seriously.

James Thompson a solicitor within the Safety, Health and Environment Group of Hammonds will present a seminar covering the following aspects of the legislation

• the history of why it has been necessary criminalise health and safety regulation
• the new offence of corporate manslaughter
• existing personal liability under the criminal law for deaths in the workplace
• the health and safety duties all employers must discharge
• how to deal with a regulatory investigation - police/EA or HSE as well as local authority
• post accident investigation reports - can they be made legally privileged?
• tips and tactics on how to best protect yourself and your company from prosecution
