The HSE publishes Guidance both specific to particular industries and to particular processes.Following Guidance is not compulsory, but doing so will normally ensure an employer is doing enough to comply with the law. Approved Codes of Practice give practical examples of good practice and help in interpreting the Act. If an employer is prosecuted for a breach of health and safety law, and it is proved that they have not followed the relevant Codes of Practice the Court can find them at fault. |
