The Regulatory Enforcement and Sanctions Act 2008 (the RES Act) establishes a statutory framework for the creation of new powers for regulators to impose “civil sanctions”. A Government consultation in 2009 set out draft legislation and draft guidance containing a proposed regime to establish these new sanctions for use by the Environment Agency (Fairer and Better Environmental Enforcement – consultation closed October 2009).
